In theory at least, terminated or laid-off workers are eligible for collecting unemployment except in cases of willful misconduct or an unjustified quit on the part of the employee. In our experience, unemployment benefits cases can often fall into one of several patterns:

  • The employer dismisses the worker for a reason that would support the award of benefits, but opposes the application on the ground of willful misconduct by stating a different reason for the termination
